01Agreeing to these terms#

These terms are an agreement between you and the operator of Echo ("we", "us"), an individual developer based in Ontario, Canada. They cover your use of the Echo desktop app and related services ("Echo").

You agree to these terms when you create an account or sign in, where the screen tells you that continuing means agreeing, and each time you use Echo. Please read them first. If you don't agree, don't sign in or use Echo.

Our Privacy Policy explains how we handle personal information and forms part of this agreement.

02Eligibility and your account#

You must be at least 18 and able to enter into a binding contract. The beta is not offered to or directed at people in Quebec, the European Union, the European Economic Area or the United Kingdom. Keep your password and sign-in secure. You are responsible for what happens under your account.

03Beta service#

Echo is a beta. We work to keep it reliable, but features may change, break or be withdrawn, and data may be lost. Keep your own copy of anything you can't afford to lose. We may pause or end the beta at any time; if we end it, we will try to tell you first. Echo has daily usage limits. If you reach one during a call, the call ends.

Echo can hide its windows from screen sharing. Whether this works depends on your device, operating system and the other apps you use, so we can't promise it will work every time.

04Recording and consent#

Echo transcribes both sides of your calls, including what other people say. It does not join your call or announce itself, so other participants won't know it is running unless you tell them. By default it shows a reminder at the start of each call to tell participants and get their consent where the law requires it. You can turn that reminder off, but your legal duties stay the same. Hiding Echo from screen sharing doesn't change them either.

You decide when Echo runs, so you are responsible for following the recording and privacy laws that apply to your calls, including getting every participant's consent where required. Some places, including California, require everyone on a call to agree. Don't use Echo on a call unless you have the consent the law requires, and never on a call you are not part of.

05Your content and how we use it#

Your call audio, transcripts, notes and questions ("your content") stay yours.

You give us permission to process your content only on your behalf and at your direction, to provide Echo to you. Echo processes a call because you chose to run it. We don't use your content for our own purposes, we don't sell it, and we don't use it to train AI models. Our AI providers are not allowed to train on it under the terms on which we use their services.

You confirm you have the rights and consents needed for us to process your content this way.

06AI output and its limits#

Echo's transcripts, notes, cards, summaries and answers are produced automatically by AI. They can be wrong in ways that look right. In particular, Echo can:

  • mishear words, names and numbers;
  • attribute something to the wrong speaker, or give someone the wrong name;
  • say someone contradicted themselves when they didn't;
  • leave out things that were said;
  • rely on web sources that are wrong, out of date or misread;
  • be misled by what other people on a call say or show, including things said or shown to steer it.

Don't rely on Echo for medical, legal, financial, safety or emergency decisions. Check anything important against the source, and keep your own record of anything that matters. Echo is not a substitute for professional advice.

07Acceptable use#

You must not:

  • break any law using Echo, including recording, privacy and confidentiality laws;
  • capture a call you are not part of;
  • use Echo to harass, deceive or harm anyone, or to infringe their rights;
  • interfere with, overload, reverse engineer or gain unauthorised access to Echo or its systems;
  • resell or share access to Echo without our written permission.

08No guarantees#

Echo is provided as is and as available. To the extent the law allows, we make no promises about it, express or implied, including that it will be accurate, uninterrupted, without errors, fit for a particular purpose or of merchantable quality. Where the law where you live doesn't allow some of these to be excluded, they apply only to the minimum extent it requires.

09Limits on our liability#

Echo is a beta run by one developer. So, to the extent the law allows:

  • we are not liable for indirect or consequential losses, such as lost profits, business, data or goodwill, or for punitive damages; and
  • our total liability for all claims about Echo or these terms is limited to the greater of CAD $100 and what you paid us in the 12 months before the claim.

Nothing in these terms limits our liability for fraud, gross negligence or intentional misconduct, for death or personal injury we cause, or for anything else the law says can't be limited, including your rights as a consumer. If you live in Quebec, this section doesn't apply to the extent the Civil Code of Québec or the Consumer Protection Act forbids it.

10Claims caused by your use#

If someone makes a claim against us because of how you used Echo, you will cover our reasonable losses and legal costs, to the extent they arise from:

  • your breach of these terms or of the law;
  • your content; or
  • a claim by anyone on your calls, including a claim that you did not get consent the law required.

This doesn't apply to the extent the claim was caused by our own breach, negligence or misconduct, or where the law doesn't allow it. We will tell you promptly about the claim and may control its defence. We won't settle in a way that admits fault on your behalf without your agreement, and you agree to cooperate reasonably.

11Ending your use#

You can stop using Echo at any time. To have your account and data deleted, email support@strategi.pro. We complete deletion within 30 days, as our Privacy Policy explains.

We may suspend or end your access if we reasonably believe you have broken these terms or the law, or that your use puts others or us at risk. Where it is safe and lawful to do so, we will tell you why.

Parts of these terms that by their nature should continue after your use ends will continue, including those on your content, AI output, liability, claims caused by your use and disputes.

12Disputes#

If you have a problem with Echo, tell us first at support@strategi.pro. We will try in good faith to resolve it within 30 days. We won't start a claim against you during that time, and we ask you to give us the same chance. This doesn't limit your right to go to court, and a claim can always be started sooner if a limitation period would otherwise run out.

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Claims go to the courts of Ontario, unless the law where you live lets you bring them in your local courts.

Nothing in these terms takes away protections you have under the mandatory law of the place where you live, including any right to go to court or to join a class proceeding. Nothing in these terms shortens any limitation period.

13Changes to these terms#

We may update these terms. We will post the new version here and change the date at the top.

For a material change, we will tell you in the app or by email at least 30 days before it takes effect. We may make a change sooner where the law requires it or to deal with a security risk, and we will tell you as soon as we can.

If you don't agree to a change, stop using Echo before it takes effect and email support@strategi.pro to have your account deleted. If you keep using Echo after it takes effect, the new terms apply.

If you live in Quebec: the parts of these terms we may change are Echo's features, how we handle your content, acceptable use, and the rules on guarantees, liability, claims caused by your use, ending your use and disputes. At least 30 days before a change takes effect, we will send you a written notice showing the new or changed wording, the wording it replaces, the date it takes effect, and your right to refuse it. You can refuse by closing your account, at no cost, up to 30 days after the change takes effect.

14General#

If a court finds part of these terms unenforceable, that part is limited only as much as needed and the rest stays in effect. If we don't enforce something right away, we haven't given it up. You may not transfer this agreement without our consent. We may transfer it as part of a sale or reorganisation of Echo. These terms and our Privacy Policy are the whole agreement between us about Echo.
